SIMTEL TEAM it is fully responsible for the processing of personal data that it collects in the daily conduct of its activities and guarantees the protection of such personal data in accordance with the provisions of Regulation (EU) 679/2016 Of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/CE (hereinafter referred to as „Regulation GDPR”).

This document explains the type of personal data we process, the purpose and basis for which we process it, and the duration for which we retain this personal data.

1. GENERAL INFORMATION

is a personal data operator, as defined by the legislation in force, more specifically, the GDPR Regulation known under the acronym G.D.P.R. This means that it has control over the personal data collected and decides on how to process it. As a result, the Company has implemented in business processes a series of policies, procedures, technical and organizational measures to secure these data and to ensure the respect of the rights of the data subjects.

Simtel Team processes personal data about you through several methods:

Simtel Team collects financial data about legal entities and personal data about the shareholders, administrators, legal representatives and censors of these legal entities from public sources such as, but without being limited to these: Trade Register, Official Gazette, ANAF, Ministry of Finance, Bulletin of Insolvency Procedures, Electronic Archive of Real Movable Guarantees, Ministry of Justice, etc..

When you visit the website Simtel https://www.simtel.ro/ we will collect information about you using files called “cookies”, small files on your equipment. Cookies are not viruses, but data files that allow us to identify you on your next visit to our website, to improve and personalize the services we offer you through our website. When you wish to apply for a job vacancy and send us your CV and/or cover letter by e-mail, we will collect and process the submitted information. More information about data processing in this process can be read Information note on data processing in the online recruitment process.

When you send an e-mail about a possible order to one of the representatives of Simtel Team.

Simtel Team will be able to process your data on the basis of express and freely expressed consent. By the consent of the data subject we mean any manifestation of free will, specific, informed and unambiguous of the data subject by which he or she accepts, by a statement or by an unequivocal action, that the personal data concerning him be processed.

3. THE PURPOSE AND LEGALITY OF THE PROCESSING OF PERSONAL DATA

Simtel Team uses your personal data lawfully, in accordance with the applicable legal provisions and in full compliance with the provisions of the GDPR Regulation, specific to art. 6.1, as follows:

  • In the case of requests received from the competent state authorities, we will cooperate and provide data, including personal data, with careful verification of the legality of these requests;
  • We will cooperate with the competent authorities in situations involving illegal activities, fraud activities and so on, providing data (including personal data) after verifying the legality of requests.

If we need to process your personal data for purposes other than those described in this document, we will only do so with your prior information or consent (expressed in advance).

4. HOW TO STORE AND PROCESS PERSONAL DATA. THE SECURITY MEASURES.

The personal data collected by Simtel Team are processed in the European Union, in the Simtel Team locations, at ITC infrastructure service providers and/or providers of specific applications:

In developing the ITC infrastructure Simtel Team took into account the best practices in the field, as follows:

  • The virtual perimeter of the organization is secured with firewall equipment;
  • The physical perimeter of the organization is secured with CCTV equipment;
  • Simtel Team activity-specific applications are regularly updated as technology providers publish patches;
  • Domestic servers and equipment are protected with anti-virus and anti-malware applications;
  • Internal user equipment and certain critical databases will be protected with encryption applications, if any;
  • Access to user systems and applications is controlled and monitored;
  • Critical communication infrastructure is provided with emergency power systems.

Simtel Team will not make public and will not transfer your personal data to unauthorized entities.

5. DURATION OF STORAGE OF PERSONAL DATA

Your personal data will be stored strictly for the duration necessary to fulfill the purpose for which they were collected or for the duration required by the fulfillment of legal obligations.

For example, the data in the contact forms will be kept for 6 months from the moment of their transmission.

For commercial contacts, after their closure, personal data will be kept for a period of 36 months for the realization of legal rights, if applicable. Also, after the termination of the contract, according to the tax legislation applicable to payments, personal data from payment instruments and contract will be stored for a period of 10 years.

If a contract does not occur between you and Simtel Team, your data will be kept for a period of 12 months.

After the expiry of the storage period, your personal data will be deleted.

6. THIRD-PARTY ACCESS TO YOUR INFORMATION

The information is not shared with third-party companies, except for the service providers that make our website usable and the providers indispensable in the execution of the contractual obligations assumed Simtel Team may sometimes be required to disclose your data to third parties, such as local authorities, courts, regulators and / or law enforcement agencies for the purpose of complying with applicable laws and regulations or in response to a legal proceeding.

We will only disclose your personal data to public bodies if required by law. For example, Simtel Team will respond to requests from courts, law enforcement agencies, regulatory agencies and other public and official authorities, which may include such authorities also from outside the country of residence.

9. INTERNATIONAL PERSONAL DATA TRANSFERS

Your personal information may be transferred to recipients established outside the European Economic Area. We will ensure that all transfers take place in accordance with applicable data protection laws, including by entering into data transfer contracts if necessary.

Any transfers of personal data to countries other than those for which a decision has been taken on the adequacy of the level of data protection by the European Commission, as listed on the official websites, it is performed on the basis of contractual agreements that use standard contractual clauses adopted by the European Commission or other appropriate guarantees, in accordance with the law in force.

10. THE BUSINESS TRANSFERS

In connection with any reorganization, restructuring, merger or sale or other transfer of assets (collectively referred to as „ Business transfer“ “), we will transfer data, including personal data, including, in a reasonable volume and as required for the Transfer of Business, and provided that the receiving party agrees to respect your personal data under the applicable data protection legislative framework.

The Company will continue to ensure the security and confidentiality of any personal data and notify affected users before personal data becomes subject to another policy of processing personal data.

11. YOUR RIGHTS UNDER REGULATION 679/2016 GDPR

As a data subject, you have specific rights with respect to the personal data we collect from you. Simtel Team will respect your individual rights and handle your interests properly.

Right of withdrawal of consent: You may withdraw your consent to the processing of personal data at any time.

Right to rectification: You may obtain from us the rectification of personal data concerning you. We make reasonable efforts to retain personal data – which is used continuously and which is in our possession or control – accurate, complete, current and relevant, and, based on the latest information available to us.

Right to restriction: You may obtain from us the restriction of the processing of personal data if:

  • you dispute the accuracy of your personal data for the period in which we need to verify the accuracy, the processing is illegal and you request the restriction of processing rather than the deletion of personal data;
  • we no longer need your personal data, but you request it to establish, exercise or defend a right;
  • you object to the processing while we check whether our legitimate grounds prevail over yours.

Right of access: You can ask us for information about the personal data we hold about you, including information on what categories of personal data we have in our possession or control, what they are used for, where we collected them, and, if they are not collected directly from you and to whom they have been disclosed, if any. You may obtain a copy from us, free of charge, containing the personal data we hold about you. We reserve the right to charge a reasonable fee for each additional copy you may request.

Right to portability: Upon request, we will transfer personal data to another controller, where technically possible, provided that the processing is based on your consent or is necessary for the performance of a contract.

Right to erasure: You may obtain from us the erasure of your personal data if:

  • your personal data is no longer necessary for us in relation to the purposes for which they were collected or otherwise processed;
  • you have the right to object to further processing of your personal data (see below) and to exercise this right of objection to processing;
  • personal data has been unlawfully processed.

Unless processing is necessary:

  • in order to fulfill a legal obligation that requires processing by us;
  • in particular for statutory data retention requirements;
  • for the establishment, exercise or defence of a right.

Right of objection: You can object – at any time – regarding the processing of personal data. In this case, we will no longer process the personal data if we cannot demonstrate legitimate, legitimate reasons, a major interest in the processing or for the establishment, exercise or defence of a right. If you object to the processing, please specify whether you want the deletion of personal data or the restriction of their processing by us.

The right to lodge a complaint: In case of an alleged violation of the law in force on confidentiality, you can file a complaint with the National Supervisory Authority for Personal Data Processing.

Please note:

Time period: We will try to fulfill the request for the exercise of a right within 30 days of its receipt. However, the time limit for reply may be extended for specific reasons relating to the specific right or complexity of the request.

Restricting access: In certain situations, we may not be able to grant you access to all or part of your personal data due to legal provisions. If we refuse your request for access, we will inform you of the reason for refusal.

In your request, please identify and detail your request with information about the relationship you have with Simtel Team and the period referred to.

We reserve the right to verify your identity according to the provisions of Regulation 679/2016 GDPR.

Impossibility of identification: In some cases, we may not be able to search for your personal data due to the lack of identification elements provided in your request.

In such cases, where we cannot identify you as the data subject, we are not in a position to comply with your request to exercise your legal rights as described in this section, if you do not provide additional information allowing identification.
